What Justifies a Modification?

 

Florida courts require a substantial, material, and unanticipated change in circumstances to approve a child support modification. This means the change must be significant, ongoing, and something that wasn’t expected at the time of the original order.

 

Some common examples include:

 

  • A major increase or decrease in either parent’s income
  • A change in the child’s healthcare, education, or other expenses
  • A shift in custody or time-sharing that affects who provides day-to-day care
  • One child aging out while others remain covered by the order

 

 

How the Process Works

 

To modify a child support order, you must file a Supplemental Petition to Modify in the county where the original order was entered — or where your child lives now. If both parents agree to the new terms, the process is usually quick. If not, it can involve hearings and evidence.

 

Keep in mind:

 

  • You must provide documentation (pay stubs, tax returns, parenting schedules, etc.)
  • Courts won’t approve minor changes — they generally require at least a 15% or $50/month difference in the payment amount
  • You can’t stop paying the original order while waiting on a modification
